Big Love Rescue Contract

GUARANTEES BY THE ADOPTER
___1. This dog will receive the highest quality of care including food, water, shelter, active companionship, socialization, appropriate veterinary care, exercise, and love. This is to assure proper development and/or maintenance of the temperament, health, happiness, and well-being of the animal. If it is evident that this dog is not receiving the care necessary to maintain proper health and temperament, liquidated damages of $5000.00 will be owed immediately to Big Love Rescue. Big Love Rescue's reasonable attorney fees for recovery of the Dog and/or the collection of the liquidated damages will be paid by the Buyer. Additionally, the buyer’s rights and ownership of the dog will immediately terminate and revert back to the Breeder who may immediately assume possession of the dog.

___2. This dog will NEVER be used for dog-fighting. If it is found that this dog was used for dog fighting, Big Love Rescue's reputation will be damaged; liquidated damages of $5000.00 will be owed immediately to Big Love Rescue. Big Love Rescue's reasonable attorney fees for recovery of the Dog and/or the collection of the liquidated damages will be paid by the Buyer. Additionally, the buyer’s rights and ownership of the dog will immediately terminate and revert back to the Breeder who may immediately assume possession of the dog.
___3. This dog is NOT to be sold or given to an individual, a research facility, a shelter or humane society, or turned over to a rescue organization. If the Dogo is no longer wanted, the Breeder will take the dog back.
___4. Adopter agrees to notify the Big Love Rescue Immediately if at any time this Dog is lost or stolen, and to make every effort to locate this Dog.
___5.  This Dog is placed as a pet; therefore, it is being placed with no purebred registration. Adopter understands that this means they cannot show this dog in conformation shows and  cannot breed this dog. The dog must be spayed/neutered within 6 months of adoption.
___6. The Adopter acknowledges and agrees that other dominant breeds of dogs may not be compatible living companions for your Rescue Dog for reasons of dominance, aggression, or sex. The adopter must give full disclosure to the breeder as to any other dog(s) in his/her ownership or possession at the time of this sale, so that their compatibility with this dog and/or adequacy of the adopters facilities for the purposes of ensuring the safety and well-being of this dog can be assessed by Big Love Rescue before the final adoption takes place, for these are important factors in the Rescues decision to place the dog with the adopter, and the adopter hereby states that he/she has indeed provided full disclosure of this information to the adopter, if, after the date of this contract, the adopter discovers that the adopter has not been honest about their other pets, Big Love Rescue may require the Adopter fulfill certain actions that will ensure the future safety and well-being of the dog, and the Adopter will be responsible for the cost of such, or Big Love Rescue may demand the return of the dog from the Adopter to the Rescue without any compensation to the buyer.
___7. The Adopter acknowledges and agrees that the Rescue has fully explained to him/her the naturally occurring dog-aggressive characteristics, the dominant nature of the large dominant breeds, and the possibility for this Dog to do great harm, and the adopter fully understands them; that the Rescue has stressed the need for, and recommended the undertaking of proper socialization and professional training of this dog in this regard, and that Big Love Rescue is in no way responsible for or to be held accountable for any future occurrences relating to this Dog owned by the adopter.
___8. The Adopter agrees to send two photos a month to the Rescue, for the first 6 months. After that one per year will be good, any pose will do.
___9. The Adopter agrees that this contract will be bound by the laws of the State of New York, and that any dispute regarding this contract, or the Dog, will be settled in a New York court.
___10. The Adopter agrees to notify the Rescue if any location change is necessary for the dog.
___11. The Adopter agrees to notify Big Love Rescue if there is any serious illnesses/injury that requires the dog undergo surgery or prolonged medical attention.
